Kindly be advised that Jochen Eckhoff and Johanna Thoriso Leso will attend to the liquidation of Peninsula Brake & Truck Spares CC (In Provisional Liquidation) “PBTS”. Furthermore, all communications regarding this estate (progress reports, creditor reports, meeting of creditors) will be done via this online estate profile. You will receive notifications, via email, when we update the estate.
Kindly be advised that PBTS was provisionally liquidated on 17 August 2017. Furthermore, The Master of the High Court, Cape Town, appointed Jochen Eckhoff (Summit Trust) and Johanna Thoriso Leso to be the liquidators of the company on 30 August 2017.
Please be advised that when a company is in provisional liquidation it is the duty of the liquidators to, inter alia, take charge of the company’s assets and not to comment on its affairs. The liquidators will submit a formal creditors report in terms of section 79 of the Close Corporations Act at the second meeting of creditors. Further instructions and information will follow from the liquidators if the order is made final on 03 October 2017.
The provisional order of liquidation was made final on 03 October 2017. The Liquidators will, within a month, convene by notice in the Gazette, a first meeting of the creditors and members of the corporation for, inter alia, the proof of their claims against the corporation. The Liquidators shall publish such notice on a date not less than ten days before the date upon which the meetings is to be held and shall in such notice state the time and place at which the meeting is to be held. The liquidators will also make the notice available on this website.
The statutory first and second meeting of creditors and members, in terms of section 78 and 79 of the Close Corporations Act No 69 of 1984, as amended, will be held at the Magistrate’s court, Bellville, on 10 November 2017 at 11h00.
The first and second meeting of creditors was successfully held and closed. The liquidators will now proceed in accordance with the section 79 report and creditors directions. The first liquidation and distribution account will be submitted by 2 March 2018.
