Welcome to Summit Trust.
Kindly be advised that Jochen Eckhoff and Tsiu Vincent Matsepe will attend to the liquidation of Cosmo Fruit (Pty) Ltd (In Provisional Liquidation) “Cosmo”. Furthermore, all communications regarding this estate (progress reports, creditor reports, meeting of creditors) will be done via this online estate profile. You will receive notifications, via email, when we update the estate.
Kindly be advised that Cosmo was Provisionally Liquidated on 29 August 2016. Furthermore, The Master of the High Court, Cape Town, appointed Jochen Eckhoff (Summit Trust) and Tsiu Vincent Matsepe as Provisional Liquidators of Cosmo on 7 September 2016.
Please be advised that it is our duty as Provisional Liquidators to secure the assets of Cosmo and not to comment on the company’s affairs. Having said that, the Provisional Liquidators will submit a preliminary creditors report if the order is made final on 10 October 2016.
The provisional order of liquidation was made final on 10 October 2016 2016. The Master of the High Court will now convene by notice in the Gazette, a first meeting of the creditors of the estate for the proof of their claims against the estate. The Master’s shall publish such notice on a date not less than ten days before the date upon which the meeting is to be held and shall in such notice state the time and place at which the meeting is to be held. When, where and how do I prove my claim ?
The first meeting of creditors will take place at The Master of the High Court, Cape Town on 9 December 2016 at 09:00.
The first meeting of creditors was successfully held and closed. The liquidator shall, within three months, convene the second meeting of creditors. The purpose of the meeting is to prove claims against the estate, adopt resolutions and to table a formal creditors and contributories report. The time, date and place of the second meeting of creditors and the formal creditors and contributories report will also be made available on this website.
The Statutory Second Meeting of Creditors, Members and Contributories will be held before The Master of the High Court, Cape Town, on Friday, 24 February 2017 at 09h00 for further proof of claims against the company, to receive the Joint Liquidators’ Report and to give directions to the Joint Liquidators regarding the administration of the estate.
The second meeting of creditors was successfully held and closed. The liquidators will now proceed in accordance with the liquidators 402 report and creditors directions. The first liquidation and distribution account will be submitted by 15 June 2017.
Please be advised that a special and general meeting of creditors will take place on 23 June 2017 at The Master of the High Court, Cape Town at 09:00. The purpose of this meeting will be to hold an enquiry.
Please be advised that the special and general meeting of creditors was postponed to 20 November 2017 for the purposes of holding an enquiry.

The enquiry will be transferred to the Magistrate’s Court, Cape Town, which will allow the presiding officer to issue warrants of arrest for witnesses who did not attend the enquiry despite being subpoenaed thereto.
