Kindly be advised that Jochen Eckhoff and Farahnaaz Safodien will be attending to the liquidation of Park 2000 Development (II) (Pty) Ltd (In Liquidation) “Park 2000”. Furthermore, all communications regarding this estate (progress reports, creditor reports, meeting of creditors etc.) will be done via this online estate profile, the Government Gazette and one or more newspapers circulating in the district in which the company was registered or had its main place of business. If you register to this online estate profile you will receive notifications, via email, every time it is updated. In this regard, we kindly request that you familiarize yourself with our disclaimer available at the bottom of the webpage.

 

Kindly be advised that Park 2000 was voluntary liquidated by the Directors and Members of the company via the CIPC in terms of section 352(2) of the Companies Act 61 of 1973 on 17 February 2022. Furthermore, The Master of the High Court, Cape Town , “The Master” appointed our Jochen Eckhoff (Summit Trust) and Farahnaaz Safodien as Provisional Liquidators of Park 2000 on 25 March 2022. It is the duty of the Provisional Liquidators to take control of the company’s assets and not to report on the company’s affairs. The Liquidators will submit a formal report at the second meeting of creditors and contributories in terms of section 402 of the Companies Act No. 61 of 1973.

 

The Master will now convene, by notice in the Gazette, a first meeting of the creditors and members of the estate for, inter alia, the proof of their claims against the estate. The Master shall publish such notice on a date not less than ten days before the date upon which the meetings is to be held and shall in such notice state the time and place at which the meetings is to be held.

 

Kindly download the claim form which you will see on the right-hand side of your screen. The claim must be completed, signed, commissioned and supported with documents proving your claim. If the claim is in your personal capacity, then you must complete the power of attorney for a representative, who will prove your claim at the creditors meeting, but if Park 2000 owes a company money which you represent then both the company resolutions and the power of attorney, attached to the claim, must be completed. If goods were sold and delivered to Park 2000 on an open account then a statement must be submitted in support of the claim showing the monthly total and a brief description of the purchases and payments for the full period of trading or for the period of 12 months immediately before the date of liquidation.

 

The claim must be emailed to our offices, Stephan@summittrust.co.za, within 14 days from 30 March 2022. If the claim is correct, we will advise you to deliver or courier the original claim to our offices: Summit Trust, 2nd Floor, 155 Loop Street, Cape Town.

 

The first meeting of creditors and members was successfully held and closed on 3 June 2022 at the Magistrate’s Court, Bellville at 11h00. The Liquidators shall, within three months, convene the second meeting of creditors and contributories. The purpose of the second meeting of creditors and contributories is to prove additional claims against the estate, adopt resolutions and to table a formal report to creditors and contributories. The time, date and place of the second meeting of creditors and contributories will be made available on this website.

 

The second meeting of creditors and contributories will be held at Magistrate’s Court, Bellville on 19 August 2022 at 11h00.

 

The second meeting of creditors and contributories was successfully held and closed. The Liquidators will now proceed to wind-up the company in accordance with their report and resolutions adopted at the second meeting of creditors and contributories. The first Liquidation and Distribution account will be submitted by 20 December 2022.

 

A special meeting for the purposes of proving late claims will be held at the Magistrate’s Court, Bellville on 11 November 2022 at 11h00. Creditors who still intend to prove a claim should contact  Stephan@summittrust.co.za at their earliest convenience.

 

An enquiry in terms of Section 415 of the Companies Act 61 of 1973 into the affairs of the company will be held on 24 March 2023 at 09h00 before the Presiding Officer at the Bellville Magistrate’s Court.

 

The enquiry in terms of Section 415 of Companies Act has been postponed to 9 June 2023.

 

Creditors are kindly requested to consider the uploaded report and request for directions from the joint liquidators, whereafter they should provide the liquidators with their direction by completing the uploaded voting form and emailing same to madison@summittrust.co.za. The liquidators will proceed to convene a special and general meeting of creditors for the purposes of proving further claims and to record the creditors’ directions.

 

The date and time for the abovementioned special and general meeting of creditors will be communicated in due course.

 

The special and general meeting of creditors and members to consider the creditors’ votes will be held at the Bellville Magistrate’s Court on 1 December 2023. Creditors who are yet to provide their vote is advised to do so as a matter of priority.

 

The special and general meeting of creditors and members was held and closed at the Bellville Magistrate’s Court on 1 December 2023. All the creditors who submitted their votes elected to instruct the liquidators to proceed to wind-up the company without further delay.

 

A creditor has objected to the Final Liquidation and Distribution Account, to which the liquidators have responded to. The creditor should now deliver a reply to the liquidators’ response whereafter the Master will exercise his/her discretion and issue a ruling on the objection. The liquidators cannot comment on a timeline for this process to be finalized.

 

The further special of creditors and members has been convened to take place at Magistrate’s Court, Bellville on 28 June 2024 at 11h00.

 

The special and general meeting of creditors and members was held and closed at the Bellville Magistrate’s Court on 28 June 2024. All the creditors who submitted their votes elected to instruct the liquidators to proceed to wind-up the company without further delay.
