Please be informed that Jochen Eckhoff and Tshifhiwa Perseverance Mudzusi will be attending to the liquidation of Strydom En Pretorius CC (In Liquidation) “Strydom en Pretorius”. Furthermore, all communications regarding this estate (progress reports, creditor reports, meeting of creditors etc.) will be conducted through this online estate profile, the Government Gazette and one or more newspapers circulating in the district in which the close corporation was registered or had its main place of business. If you register to this online estate profile, you will receive notifications, via email, every time it is updated. Please be informed that Strydom en Pretorius CC was voluntarily liquidated by the Members of the close corporation via the CIPC in terms of section 352(2) of the Companies Act 61 of 1973 on 5 March 2024 Additionally, The Master of the High Court, Cape Town, “The Master” appointed Jochen Eckhoff (Summit Trust) and Tshifhiwa Perseverance Mudzusi as liquidators of Strydom en Pretorius CC on 25 March 2024.  At this point in the liquidation, it is the duty of the liquidators to take control of the close corporation’s assets and not to report on the close corporation’s affairs. The liquidators will submit a formal report at the second meeting of creditors and members as required by section 79 of Close Corporations Act 69 of 1984.

 

The liquidators will convene, by notice in the Gazette, a first meeting of the creditors and members of the estate for the purpose of considering the statement as to the affairs of the corporation lodged with the Master by the member(s), proving claims against the estate, deciding whether a co-liquidator should be appointed and receiving or obtaining directions or authorization in respect of any matter regarding the liquidation. The liquidators shall publish such notice on a date not less than ten days before the date upon which the meeting is to be held and shall in such notice state the time and place at which the meeting is to be held.

 

Please download the claim form which you will see on the right-hand side of your screen. The claim must be completed, signed, commissioned, and supported with documents proving your claim. If the claim is in your personal capacity, then you must complete the power of attorney for a representative, who will prove your claim at the creditors meeting, but if Strydom En Pretorius CC owes a company money which you represent then both the company resolutions and the power of attorney, attached to the claim, must be completed. If goods were sold and delivered to Strydom En Pretorius CC on an open account basis then a statement must be submitted in support of the claim showing the monthly total and a brief description of the purchases and payments for the full period of trading or for the period of 12 months immediately before the date of liquidation, 5 March 2024, whichever is the lesser.

 

Please email the claim to our offices, Stephan@summittrust.co.za and Raaiqah@summittrust.co.za, within 14 days from 10 April 2024. If the claim is correct, we will advise you to deliver or courier the original claim to our offices: Summit Trust, 2nd Floor, 155 Loop Street, Cape Town.

 

The first meeting of creditors and members was successfully held and closed on 03 May 2024 at Paarl Magistrate’s Court at 09h00 The liquidators shall, within three months, convene the second meeting of creditors and members. The purpose of the second meeting of creditors and members is to prove additional claims against the estate and to table a formal report to creditors and members. The time, date and place of the second meeting of creditors and members will be made available on this website.

 

The second meeting of creditors and members will be held on 16 August 2024 at Paarl Magistrate’s Court at 09h00.

 

The second meeting of creditors and members has been successfully held and closed. The liquidators will now proceed to wind-up the close corporation in accordance with their report and resolutions adopted at the meetings of creditors and members. The first account will be submitted by 25 September 2024.

 

A special meeting of creditors for the proof of late claims will be held before the Presiding Officer at Paarl Magistrate’s Court on 18 October 2024 at 09H00.

 

Due to a delay in publication of the Government Gazette legal notice publications, the notice of the special meeting was not published. Therefore, the special meeting of creditors will not proceed until further notice.

 

The special meeting of creditors and members will be held on 6 December 2024 at Paarl Magistrate’s Court at 09h00.
